Terms of Service

1. Acceptance of Terms
By accessing or using the Lynxiz website (lynxiz.com) or engaging our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services. These terms apply to all visitors, clients, and others who access or use our services.
2. Services
Lynxiz provides creative technology services including web development, mobile app development, AI and automation solutions, brand identity design, digital marketing, game development, 3D and CGI production, enterprise software solutions, and SaaS products. The specific scope, deliverables, timelines, and pricing for any engagement are governed by a separate Project Agreement or Statement of Work signed by both parties.
3. Intellectual Property & Ownership
Upon receipt of full payment, Lynxiz transfers all intellectual property rights in the custom deliverables created for you to you, including source code, design files, and creative assets. Lynxiz retains the right to display the work in our portfolio and marketing materials unless otherwise agreed in writing. Pre-existing materials, frameworks, and tools developed by Lynxiz prior to your engagement remain the property of Lynxiz and are licensed (not sold) to you for use in your project.
4. Payment Terms
Payment terms are as specified in your Project Agreement. Typically, projects require a deposit before work commences, with the remainder due on delivery or in agreed milestone payments. Late payments may incur interest charges as specified in your agreement. Lynxiz reserves the right to pause work on a project where payment is overdue by more than 14 days.
5. Confidentiality
Both Lynxiz and the client agree to keep confidential any proprietary or sensitive information shared during the course of an engagement. This includes business strategies, technical specifications, financial information, and client data. Confidentiality obligations survive the termination of any agreement for a period of three years.
6. Limitation of Liability
To the maximum extent permitted by law, Lynxiz's total liability to you for any claim arising out of or related to these terms or our services shall not exceed the total fees paid by you to Lynxiz in the twelve months preceding the claim. Lynxiz shall not be liable for indirect, incidental, special, consequential, or punitive damages.
7. Warranties & Disclaimers
Lynxiz warrants that it will perform services with reasonable skill and care. We do not warrant that our website will be uninterrupted or error-free. Results from marketing, SEO, and AI automation services depend on many factors outside our control, and specific outcomes cannot be guaranteed. We make no warranties beyond those expressly stated in your Project Agreement.
8. Cancellation & Termination
Either party may terminate a project engagement with 30 days written notice. Upon termination, you will pay for all work completed up to the date of termination. Deposits are non-refundable unless Lynxiz has not yet commenced any work on your project.
9. SaaS Products
Use of Lynxiz's SaaS products (including LynxBot, FlowDesk, LynxFlow, and BrandKit AI) is governed by the applicable product-specific terms and subscription agreement. Free trials are offered where stated. Paid subscriptions renew automatically unless cancelled before the renewal date. Refunds are handled on a case-by-case basis in accordance with our refund policy.
10. Governing Law
These Terms of Service shall be governed by and construed in accordance with applicable law. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the competent courts in the jurisdiction where Lynxiz is registered, unless otherwise agreed in writing.
11. Changes to Terms
Lynxiz reserves the right to modify these Terms of Service at any time. Changes will be effective upon posting to this page with an updated effective date. Your continued use of our website or services after such changes constitutes acceptance of the new terms.
